S 106 Agreements Planning

The structure of how the planning obligations at Merton were taken into account and calculated is set out in the spD planning commitments adopted in 2006. Since April 1, 2014, the Council has filed a complaint against Merton CIL. The Community Infrastructure Levy Regulations 2010 (as amended) limit the scope of what can be included in the new S.106 agreements for infrastructure projects to those directly related to the site and prohibit the safeguarding of S.106 agreements for projects listed in Regulation 123 and which the Council intends to be subject to CIL funding. Agreements on sustainable transport improvement and open spaces signed before 1 April 2014 continue to generate small sums of money. If you have an idea to spend some of the money, please contact your city council, which can discuss the idea with you and contact council officials to see if a project is viable and under the terms of the S.106 agreement in which the funds were received. The infrastructure financing certificate shall indicate the amount of expenditure on the withdrawal or planning commitment when appropriations have been allocated. Awarded means that the local authority has decided to retain funds for a given infrastructure or project. This was established and taken over at the same time as Merton`s checklist for the validation of planning requests, which contains revised local requirements for the information to be submitted with a construction application. The updated list of validation cheques includes a section for planning applicants who wish to explain why their specific programme cannot afford to comply with all of the Council`s planning guidelines while remaining economically profitable, which indicates what is expected of them before their construction application is processed. Developers and landowners should be aware that planning obligations may be guaranteed for purposes not covered by the SPD, in particular where tailor-made measures (e.g. B due to specific or unusual circumstances) are necessary to make development acceptable as intended.
